Rezoning
Zoning establishes the allowed land uses, development standards, and overall character of property within the City of Benbrook. When the existing zoning designation does not align with a proposed project, the property owner may apply to amend the official Zoning Map Boundary, commonly known as a Rezoning.
Rezoning Options
Rezoning requests generally follow one of two routes:
Standard Zoning District:
The property is rezoned to one of the City’s established base zoning districts (e.g., “A” One-Family District, “B” One-Family District, “G” Commerce District, “HC” Highway Corridor District, etc.). These districts have uniform, pre-defined standards for land use, density, setbacks, height, and design.Planned Development (PD) District:
The Planned Development (PD) District provides flexibility from standard zoning requirements to encourage creative, efficient, and well-designed projects. A PD may be applied to residential, non-residential, or mixed-use developments and is intended for sites where custom design standards can produce a higher quality or more coordinated result than a conventional zoning district. PD zoning allows the City to consider tailored standards, such as lot sizes, setbacks, building heights, parking, and signage, through a comprehensive site plan or set of supplemental development regulations. Each PD is adopted by ordinance and becomes a unique zoning district for the property.
Comprehensive Plan Consistency
Under Texas Local Government Code §211.004, all zoning regulations and amendments must be adopted in accordance with the City’s Comprehensive Plan and designed to promote the health, safety, and general welfare of the community.
Accordingly, every rezoning request is evaluated for consistency with the City of Benbrook Comprehensive Plan, including the Future Land Use Map, development patterns, and guiding principles.
Public Hearing Process
Rezoning applications require public hearings before both the Planning and Zoning Commission and the City Council.
Notices are mailed to surrounding property owners and published in accordance with Texas Local Government Code.
Rezoning Application and Submittal Deadlines
Applicants may submit a Rezoning Application at any time for preliminary staff review. Staff will evaluate the submittal for completeness, identify potential issues, and provide comments prior to formal scheduling.
To be placed on a specific Planning and Zoning Commission and City Council agenda, final application materials must be submitted on or before the deadline date listed on the Application Submittal Calendar.
Applications received after the published deadline will be reviewed by staff but will not be eligible to be scheduled for public hearing until the next available meeting cycle.
The rezoning review process typically includes:
Preliminary Staff Review - Application submitted for initial review and comment.
Final Submittal - Revised and complete application materials submitted by the published deadline.
Public Notice Sign - Applicant must install a zoning notice sign on the property in accordance with City and State requirements.
The proposed sign design and placement must be submitted with the application and approved by staff.
Once installed and verified, the application will be eligible to be scheduled for public hearings.
Public Hearings – Consideration by the Planning and Zoning Commission, followed by final action by the City Council.
